Terms and Conditions of the Magna Maa Online Store

1. General provisions

  1. These Terms and Conditions define the rules for using the online store available at https://magnamaa.com/ (the “Store”), placing orders, concluding sales agreements, making payments, delivery, complaints and returns.
  2. The Store is operated by MAGNA spółka z ograniczoną odpowiedzialnością with its registered office in Poznań, Poland, at ul. Grudziądzka 3, 60-446 Poznań, entered in the register of entrepreneurs of the National Court Register under KRS number 0001218930, NIP 7812103917, REGON 543787287, active VAT taxpayer (the “Seller”).
  3. Contact with the Seller is possible via e-mail: hello@magnamaa.com and by telephone: [insert telephone number].
  4. The Store sells jewellery and related products under the Magna Maa brand.
  5. The Store is intended for customers in Poland, the European Union and other countries, subject to the delivery and payment options available at checkout.
  6. The Terms and Conditions are available free of charge on the Store website in a way that allows them to be obtained, reproduced and recorded by the Customer.
  7. The law applicable to these Terms and Conditions is Polish law. This does not deprive consumers of mandatory protection granted to them under the law of their country of habitual residence where such protection cannot be excluded by agreement.

2. Definitions

  1. Customer – a natural person, legal person or organisational unit without legal personality that uses the Store or places an Order.
  2. Consumer – a natural person concluding an agreement with the Seller for purposes not directly related to their business or professional activity.
  3. Entrepreneur with consumer rights – a natural person concluding an agreement directly related to their business activity, where the agreement is not of a professional nature for that person within the meaning of Polish consumer law.
  4. Product – a movable item offered for sale in the Store.
  5. Available Product / Ready to Ship Product – a Product already made and available for dispatch within the time indicated on the Product page or at checkout.
  6. Custom Order Product – a Product made or modified according to the Customer’s individual specifications or intended to satisfy the Customer’s individual needs, including, where applicable, individually selected size, length, finish, material, stone, engraving, configuration or other non-standard personalisation.
  7. Order – the Customer’s declaration of intent submitted through the Store, aimed at concluding a sales agreement.
  8. Sales Agreement – an agreement for the sale of a Product concluded between the Seller and the Customer through the Store.
  9. Business Day – any day from Monday to Friday, excluding public holidays in Poland.

3. Technical requirements

  1. To use the Store, the Customer needs a device with internet access, an up-to-date web browser, an active e-mail address and enabled cookies and JavaScript to the extent necessary for the Store to function.
  2. The Customer must not provide unlawful content, interfere with the Store’s operation or use the Store in a manner contrary to law, good practice or these Terms and Conditions.

4. Products and Product information

  1. Information about Products, including their main features, price, availability and estimated processing time, is provided on the Product page and during checkout.
  2. Product photos are for presentation purposes. The Seller makes reasonable efforts to ensure that photos reflect the Product accurately; however, colours and details may vary depending on screen settings.
  3. Due to the nature of handmade, natural-material or individually finished jewellery, minor differences in appearance, texture, stone pattern, shade or finish may occur and do not necessarily constitute a defect, provided that the Product remains compliant with the agreement.
  4. The Seller may offer Products in two main availability models: Available / Ready to Ship and Custom Order.
  5. For Custom Order Products, the processing time may vary depending on the Product, selected options and production workload. The estimated processing time is indicated on the Product page or at checkout.

5. Prices, currency and taxes

  1. Prices in the Store are displayed in EUR.
  2. Unless expressly stated otherwise, prices shown in the Store are gross prices and include applicable VAT where required by law.
  3. Delivery costs, if not included in the Product price, are displayed before the Customer places the Order.
  4. For deliveries outside the European Union, the Customer may be required to pay customs duties, import taxes, local VAT/GST or other public charges. These charges are not controlled by the Seller and, unless expressly stated otherwise at checkout, are borne by the Customer.
  5. The total price of the Order, including taxes and delivery costs charged by the Seller, is shown before the Customer confirms the Order.

6. Placing Orders

  1. Orders may be placed through the Store website.
  2. To place an Order, the Customer selects the Product, chooses available options, adds the Product to the cart, provides the required delivery and billing data, selects the delivery and payment method, accepts these Terms and Conditions and confirms the Order using the button indicating an obligation to pay.
  3. The Customer is obliged to provide true, current and complete data necessary to process the Order.
  4. After placing the Order, the Customer receives an e-mail confirmation of the Order to the e-mail address provided during checkout.
  5. The Sales Agreement is concluded when the Seller confirms acceptance of the Order or when the payment is successfully authorised, depending on the checkout process used in the Store.
  6. If an Order cannot be fulfilled, the Seller will contact the Customer and may offer a change to the Order, a later fulfilment date or cancellation with refund.

7. Payments

  1. The Store accepts online payments via PayU and Stripe, including payment methods made available by these providers at checkout.
  2. Available payment methods may include, depending on the Customer’s country and the current configuration of the Store: payment card, online transfer, BLIK, Apple Pay, Google Pay or other methods supported by PayU or Stripe.
  3. The Order is processed after the Seller receives confirmation of successful payment, unless another payment method or processing rule is expressly indicated.
  4. The Seller does not store full payment card details. Payment card and transaction data are processed by the relevant payment provider.

8. Delivery

  1. Products are shipped from Poland.
  2. Delivery is carried out by courier or other delivery operator available for the Customer’s delivery address and selected at checkout.
  3. The available delivery methods, estimated delivery time and delivery costs are displayed in the Store before the Customer places the Order.
  4. For Available / Ready to Ship Products, the estimated dispatch time is indicated on the Product page or at checkout, for example within 24 hours or within the number of Business Days indicated for the Product.
  5. For Custom Order Products, dispatch takes place after the Product has been made or customised. The estimated production and dispatch time is indicated on the Product page, during checkout or in communication with the Customer.
  6. If an Order includes both Available Products and Custom Order Products, the Seller may dispatch the Order together after all Products are ready, unless the Customer and Seller agree on separate shipments.
  7. Delivery times are estimates and may be affected by the carrier, customs procedures, public holidays, force majeure or other circumstances outside the Seller’s control.
  8. The Customer should inspect the parcel upon delivery where possible. If the parcel is visibly damaged, the Customer should, where possible, ask the carrier to prepare a damage report and inform the Seller.

9. Right of withdrawal

  1. A Consumer and an Entrepreneur with consumer rights may withdraw from a distance Sales Agreement within 14 days without giving any reason, subject to the exceptions described below.
  2. The withdrawal period expires after 14 days from the day on which the Customer or a third party indicated by the Customer, other than the carrier, takes possession of the Product.
  3. To exercise the right of withdrawal, the Customer must inform the Seller of their decision to withdraw by an unequivocal statement sent to: hello@magnamaa.com or by post to: MAGNA sp. z o.o., ul. Grudziądzka 3, 60-446 Poznań, Poland.
  4. The Customer may use the model withdrawal form included in these Terms and Conditions, but this is not mandatory.
  5. To meet the withdrawal deadline, it is sufficient for the Customer to send the withdrawal statement before the withdrawal period expires.
  6. If the Customer withdraws from the agreement, the Seller will refund all payments received from the Customer, including the cost of standard delivery charged by the Seller, no later than 14 days from the day on which the Seller is informed of the withdrawal.
  7. The Seller may withhold the refund until receiving the Product back or until the Customer provides proof of sending it back, whichever occurs first.
  8. The refund will be made using the same payment method that the Customer used for the original transaction, unless the Customer expressly agrees to another method and it does not involve any additional costs for the Customer.
  9. The Customer must send back the Product no later than 14 days from the day on which they informed the Seller of withdrawal.
  10. The return address is: MAGNA sp. z o.o., ul. Grudziądzka 3, 60-446 Poznań, Poland, unless the Seller indicates another return address for a specific return.
  11. The Customer bears the direct cost of returning the Product, unless the Seller expressly agrees otherwise.
  12. The Customer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product.

10. Exceptions to the right of withdrawal

  1. The right of withdrawal does not apply to a Sales Agreement for a non-prefabricated Product made according to the Customer’s specifications or intended to satisfy the Customer’s individual needs.
  2. In particular, the right of withdrawal may not apply to Custom Order Products if they are made, modified, engraved, sized, configured or otherwise personalised specifically for the Customer.
  3. The mere selection of a standard variant available as a regular stock option does not automatically mean that the Product is excluded from the right of withdrawal. The exclusion applies where the Product is genuinely made or adapted to the Customer’s individual specification or individual needs.
  4. If the Store offers sealed Products that are not suitable for return for health protection or hygiene reasons, and the sealed packaging is opened after delivery, the right of withdrawal may be excluded for such Products where permitted by law.
  5. Information that a Product is a Custom Order Product or otherwise excluded from withdrawal should be provided on the Product page or during checkout before the Order is placed.

11. Complaints: Product conformity with the agreement

  1. The Seller is liable to Consumers and Entrepreneurs with consumer rights for the conformity of the Product with the Sales Agreement under applicable Polish consumer law.
  2. A Product is compliant with the agreement if, in particular, its description, type, quantity, quality, completeness, functionality and suitability for the agreed purpose are consistent with the agreement.
  3. If the Product is not compliant with the agreement, the Customer may submit a complaint and request repair or replacement, or in cases provided by law, a price reduction or withdrawal from the agreement.
  4. Complaints may be submitted by e-mail to hello@magnamaa.com or by post to: MAGNA sp. z o.o., ul. Grudziądzka 3, 60-446 Poznań, Poland.
  5. The complaint should include the Customer’s name, Order number, description of the issue, the Customer’s request and contact details. The Customer may attach photos or other evidence.
  6. The Seller will respond to the complaint within 14 days of receiving it, unless a shorter mandatory period applies.
  7. If it is necessary to examine the Product, the Seller may ask the Customer to send the Product back or provide additional information.
  8. For Customers who are not Consumers or Entrepreneurs with consumer rights, the Seller’s liability under warranty may be excluded to the extent permitted by law.

12. Warranty

  1. Products may be covered by a manufacturer’s or Seller’s commercial warranty only if such warranty is expressly granted in the Product description, warranty document or other statement.
  2. A commercial warranty does not limit the Customer’s statutory rights arising from Product non-conformity with the agreement.

13. Customer account

  1. The Store may allow Customers to create an account. Creating an account is voluntary unless otherwise indicated for specific Store functions.
  2. The Customer is responsible for keeping login details confidential.
  3. The Customer may request deletion of the account by contacting the Seller, subject to data retention required by law or necessary for the establishment, exercise or defence of claims.

14. Newsletter and marketing communication

  1. The Store may offer a newsletter or other marketing communication service.
  2. Subscription to the newsletter is voluntary and requires the Customer’s consent.
  3. The Customer may unsubscribe at any time using the unsubscribe link in the message or by contacting the Seller.

15. Reviews and user content

  1. If the Store allows Customers to publish reviews or other content, the Customer must not publish unlawful, offensive, misleading or third-party-right-infringing content.
  2. The Seller may moderate or remove content that violates these Terms and Conditions or applicable law.
  3. If the Store presents product reviews as verified, the Seller should ensure that they come from Customers who purchased or used the Product, using reasonable verification methods.

16. Intellectual property

  1. All content in the Store, including trademarks, photos, graphics, descriptions, layout and design elements, may be protected by intellectual property rights.
  2. The Customer may use Store content only for personal use connected with browsing the Store and placing Orders. Copying, distributing or using Store content for commercial purposes without the Seller’s consent is prohibited.

17. Out-of-court complaint handling and dispute resolution

  1. A Consumer may use out-of-court complaint handling and redress procedures, including assistance from municipal or district consumer ombudsmen and competent consumer protection authorities.
  2. Information on consumer rights and dispute resolution in Poland is available from the Office of Competition and Consumer Protection (UOKiK).
  3. The Customer may also use the European Online Dispute Resolution platform where available under applicable EU rules.

18. Personal data

  1. Rules for processing personal data are described in the Privacy Policy available in the Store.
  2. The data controller is MAGNA sp. z o.o. with its registered office in Poznań, Poland.

19. Changes to the Terms and Conditions

  1. The Seller may change these Terms and Conditions for important reasons, including changes in law, changes in payment or delivery methods, changes in Store functionality or changes in the Seller’s business data.
  2. Changes do not affect Orders placed before the effective date of the changes.
  3. Customers with accounts or newsletter subscribers may be informed of material changes by e-mail where required or appropriate.

20. Final provisions

  1. If any provision of these Terms and Conditions is found invalid or ineffective, the remaining provisions remain in force.
  2. Matters not regulated in these Terms and Conditions are governed by applicable Polish law, including the Polish Civil Code, the Polish Consumer Rights Act and applicable data protection regulations.
